Freedom has always been America’s global advantage. But when it comes to the quest for AI dominance, it may also be our biggest weakness.
In the U.S., guardrails around AI — privacy protections, legal frameworks and ethics and accountability — are in place to preserve our individual freedoms. For 250 years, open systems, legal protections and market competition created the conditions for innovation to emerge and scale. Today, we’re seeing how these protections can also slow things down.
In countries like China and Russia, fewer restrictions allow broader deployment and faster time-to-market for AI innovations. In the U.S., additional layers of AI governance, oversight and legal exposure are creating friction.
The recent dispute between the U.S. government and Anthropic is a case in point. What began with a disagreement over contract terms quickly raised broader questions about how AI should be used. Anthropic pushed for limits, particularly around mass surveillance of U.S. citizens and autonomous military applications. The government wanted broader authority.
For decades, freedom has enabled innovation. Now, in some cases, it is adding weight. The more freedom you preserve, the more you may limit innovation. That wasn’t always the case. What got the U.S. to this point may not sustain its position going forward.
The AI race: Government vs. business
AI is increasingly tied to national security, intelligence and military capability. In that context, speed matters. From a government perspective, the challenge is that competitors are not operating under the same constraints. If one country limits how AI can be used while another does not, that creates a capability gap.
In commercial environments, being first to market carries legal and reputational risk. It can make sense to move second, learn from early missteps and avoid exposure.
This divergence is creating tension between how AI is governed domestically and how it is deployed globally.
What this means for enterprise leaders
CIOs and enterprise technology leaders are already seeing this effect in contracts, compliance expectations and vendor relationships. The implications vary depending on what your organization does.
1. Government contractors
For organizations working with government agencies, the issue is immediate. Your contracts with government entities are likely to become more specific about your AI use. In some cases, the expectation will be broad: AI can be used in any lawful way. In others, agencies may push for more defined boundaries — what cannot be done, not just what can.
This is important because AI governance is not boilerplate. Your contracts can affect how your systems are deployed, what vendor partners are allowed to do and how risk is shared.
Review all current and future contract language closely and be prepared for any and all changes as the pace of AI innovation continues to accelerate.
2. Businesses in regulated industries
Governmental AI policies often apply to regulated industries or to adjacent industries. Industries like banking, healthcare, energy and telecommunications are already subject to federal oversight. Expectations around AI governance are likely to align with government frameworks, whether they are formally required or not.
This is a challenge because federal and state approaches are not always aligned. At the same time, auditors and regulators may expect organizations to demonstrate that they are managing AI risk in line with emerging standards.
That can affect vendor selection, internal policies and how compliance is documented.
3. Industry organizations and emerging standards
In the absence of clear, unified regulation, other groups are stepping in. Organizations like the International Association of Privacy Professionals and the Responsible AI Institute are developing frameworks, certifications and guidelines.
These groups are not government entities, but they are influential. As their standards are adopted, they can shape expectations across industries. In some cases, they may become de facto requirements, even without formal regulatory backing. That raises more questions about authority, consistency and cost.
All stakeholders need to consider ethics and organizational boundaries
Regardless of organizational type or customer mix, all business stakeholders need to consider the balance between innovation and freedom. Some organizations are building governance, security and privacy into their systems from the start. Others are focused on speed, pushing to bring capabilities to market as quickly as possible.
Organizations will be responsible for defining their own boundaries. What are acceptable AI use cases? Where are the limits? How are your policies enforced? Those decisions affect product development, partnerships and how organizations respond when expectations conflict.
The decisions ahead
AI is becoming part of how decisions are made, how systems operate and how power is exercised. But recent events suggest that guardrails still matter — trust, accountability and control are not optional.
For governments, the balance is national security and public trust. For companies and enterprise leaders, it’s about how far to push innovation and where to draw the line. You must consider how these dynamics affect vendors, contracts and risk exposure.
The trade-off between freedom and innovation isn’t going away. Organizations will need to decide how much risk they’re willing to take and where to draw limits.
